1. Acceptance of Terms

By registering for and using the SmartMenu platform, you (the "Merchant" or "User") agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

2. Description of Service

SmartMenu provides a digital menu and ordering interface that facilitates communication between Merchants and their customers via WhatsApp. SmartMenu is a service provider and is not responsible for the fulfillment, quality, or delivery of the goods ordered through the platform.

3. User Responsibilities

Account Security: You are responsible for maintaining the confidentiality of your login credentials.

Content Accuracy: Merchants are responsible for ensuring that menu items, prices, and descriptions are accurate and up-to-date.

Legal Compliance: You agree to use the service only for lawful purposes and in accordance with local regulations in your jurisdiction.

4. WhatsApp Integration

SmartMenu utilizes the WhatsApp platform to send order data. Users must comply with WhatsApp’s Business Policy.

SmartMenu is not liable for any account suspensions or technical issues arising from the WhatsApp platform itself.

5. Payments and Fees

Subscription: Fees for using SmartMenu are billed according to the selected plan (Monthly, Yearly, or Lifetime).

Transaction Fees: SmartMenu does not currently take a commission on orders unless specifically stated in a separate payment gateway agreement.

Refunds: Subscription fees are generally non-refundable unless the service is unavailable for an extended period due to our internal technical failure.

6. Limitation of Liability

To the maximum extent permitted by law, SmartMenu and its developers shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities resulting from the use or inability to use the service.

7. Data Privacy

We value your privacy. Please refer to our Privacy Policy to understand how we collect, use, and protect your data and the data of your customers.

8. Modifications to Service

We reserve the right to modify or discontinue the service (or any part thereof) with or without notice at any time. We may also update these terms periodically.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the service provider is based.
